Our Role
In our Role as your Authorized Representative (AR), we will collect the necessary evidence, prepare and present your claim to the Department of Labor (DOL) and act on your behalf before the DOL. There is a time limit for development of your claim, and if you miss those time requirements, your claim may be denied. Additionally, if you do not present the required evidence, which can be confusing and complex, you may be denied. We understand these requirements, and have dealt with them over many years. We know when to present the documentation, what must be presented and how to best represent your case. We are not compensated unless your claim is approved. By law, our compensation is limited to 2% of your award, or 10% in the case of appeals or reconsideration. There may be some small fees such as fees paid to medical facilities for copies of medical records. Payments to you for travel and medical reimbursements are NOT compensation and we are not paid any portion of those reimbursements.
Part B and Part E
Part B:
cancer due to radiation, Beryllium exposure, silicosis exposure
Under Part B, employees, their spouse, children, grandchildren or parents may be eligible for compensation if they meet the requisite eligibility requirements. We understand these requirements and are experts at presenting your claim before the Department of Labor.
Part E:
Illnesses caused by Toxic Substance exposure, including radiation
Under Part E, employees, their spouse, and their children may be
eligible for benefits and/or compensation if they meet the requisite
eligibility requirements. Grandchildren and parents are not eligible
under Part E. The requirements under Part E can be quite different than the requirements under Part B. Again, because we are experts at understanding all of the requirements, and the differences under the and Part E, we better understand how your claim should be prepared and presented.
SEC and Niosh
The SEC is a program that falls under Part B, and has specific eligibility requirements that are limited to certain DOE sites, during specified employment time periods, and for specific medical conditions. The National Institute for Occupational Safety and Health (NIOSH) is a governmental agency that calculates the probability of causation (PoC). The PoC is to determine the likelihood that cancer was caused, aggravated or contributed by DOE employment. We understand what is necessary under both the SEC and NIOSH and how to best represent your claim.
Additional Compensation and medical reimbursement
In addition to basic monetary compensation, employees may be eligible under Part E for medical benefits, impairment and/or wage loss. Spouses may be eligible for a lump sum amount for wage loss of either $25,000 or $50,000. The eligibility for these components are often missed due to lack of understanding the potential eligibility for these. Because we undestand the EEOICPA and processes, we will evaluate for potential eligibility. If found eligible under the EEOICPA, you may be eligible for medical care, and reimbursement for medical expenses, medical travel and other related expenses. Since we have dealt with and are knowledegable in these areas, we are able to advise you and assist you with your reimbursement claims.
